South Dakota voters approved both medical and recreational marijuana simultaneously in 2020, only to have the recreational measure struck down by the state Supreme Court on a legal technicality. Medical marijuana is now established, but voters' clear intent for full legalization was blocked by a procedural ruling rather than democratic will. Federal legalization would honor what South Dakotans voted for and provide a national framework that state courts cannot override.
